Terms and Conditions

These Terms and Conditions do not affect your statutory rights. This is the agreement between the customer (user, you) and Moore Books (Moore Books, we, us) . Please read these Terms and Conditions before first or further use of the Moore Books' website (Site). If you place an order with us you are deemed to have accepted these Terms and Conditions.

The Site is offered to you by Moore Books. Moore Books is based at 53 Vineyard Drive, NEWPORT, Shropshire TF10 7DF.

You consent to the Terms and Conditions when you use the Site. If you disagree with any part of the Terms and Conditions, you may not use the Site in any way.

SALE OFFER

a) When you place an 'offer to purchase goods' (order) by completing and submitting an electronic order for any material or product (in this agreement 'goods') by submitting a completed order form on our website, www.moorebooks.co.uk, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract with us. Your contract with us will only commence when we, Moore Books, confirm acceptance of your order by email or by letter. We will then agree to supply the goods listed on the said order. You will still receive an automatic confirmation that your offer to purchase (order) has been received and that the order is being processed.

b) Any advice or recommendations given by any representative of Moore Books to the buyer relating to goods, which is not confirmed in writing by Moore Books, will not be binding on Moore Books.

c) Any variation to these terms and conditions will be acknowledged on the website.

d) Throughout the website and ordering process and in all correspondence we use the English Language. No other languages are available on this website.

ORDERING

a) In submitting an order the buyer acknowledges that:

b) All information and specifications relating to the goods produced by a publisher are approximate and all errors on the website may be corrected without any liability to Moore Books. Covers may vary from those supplied because of monitor and printer capabilities and last minute changes made by publishers.

c) Moore Books may make any changes to the specification of the goods to conform to any statutory or European requirements.

d) Out of Stock
Customers who have placed orders for items temporarily out of stock will be informed within 14 days. These items will be recorded and supplied when available.

e) Standing Orders for Annual Titles
If you wish to ensure immediate delivery of any annual titles without having to regularly re-order, you may place a standing order with us. Please notify us if you wish to receive a proforma for any annual work on publication.

RIGHT OF WITHDRAWAL

a) The buyer has the right to withdraw from the contract within 14 working days of submitting the order for the goods by giving written notice of withdrawal and Moore Books shall credit the buyer's card for the price of the goods withdrawn. This will include any charges made against small orders and any postage charge levied.

PRICING POLICY

a) The price of the goods shall be the price as quoted on the website on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by Moore Books. A confirmed buying price will be sent to you when we have accepted your order by e-mail or letter. Moore Books aim to provide the most accurate information on book prices at all times. In some cases we may no longer be able to obtain the book at the published price. In the event that this occurs, or in the event of a pricing error howsoever caused, we will check with you to see if you still wish to receive the item at the new price. All prices are displayed in pounds sterling (£).

b) The price of the goods does not include the cost of delivery. The Buyer will pay the delivery charge as quoted on the website on the day of purchase.

c) Moorebooks; is not VAT registered at present. Books are currently zero-rated, but many contracts, forms, audio, video tapes, and electronic products are subject to VAT at the standard rate. If there is any change in legislation, VAT will be applicable at the standard rate in accordance with such changes. The price of the goods includes any applicable Value Added Tax (VAT), which the buyer shall be liable to pay Moore Books.

CREDIT CARDS

a) Credit and Debit cards are accepted by Moore Books for Telephone Ordering.

b) Paypal make charges to credit/debit cards will be made at the time of ordering , if Moorebooks is unable to supply these goods for whatever reason a refund will be made at the earliest opportunity and no longer than 14 days .

c) Any refund made to the Buyer's credit or Debit card shall be subject to the Terms and Conditions of the Issuing Bank and therefore be subject to any time delay as specified by the Issuing Bank. No liability shall be placed on Moore Books for any delay that is outside of their control. A correct cardholder name and address must be supplied with every order if it is different to the buyer's.

d) All accepted orders placed on this website will be processed by Paypal,.

DELIVERY

a) If the buyer does not take delivery of the goods or give Moore Books adequate delivery instructions then no duty of care shall apply, any loss or damage or deterioration to the goods shall not render Moore Books liable.

b) If the buyer does not receive all the goods as specified on the original order then the buyer must notify Moore Books in writing within 14 working days from the date of delivery. If the buyer does not inform Moore Books in writing within the specified time then no liability will be attached to Moore Books. In any event any loss or damage suffered by the buyer as a result of such a delivery shall be limited to the price of the goods not delivered or the cost of replacement goods.

c) Risk of damage or loss of the goods shall pass to the Buyer on delivery or, if the Buyer fails to take delivery of the Goods, the time when the Supplier has tried to deliver the Goods.

d) Title shall pass to the buyer on delivery of the goods.

e) UK Mainland

Goods are despatched to UK mainland addresses by first class post under one kilo (large letter and small parcels) or a carrier for large packages and over 1 kilo.

f) UK Off-Shore Islands, Northern Ireland
Orders will be despatched by post or carrier.

g) Eire, Europe and International Orders
Goods will be despatched by using the most suitable method for the goods ordered by customers.

h) Claims
Claim for non-delivery must be made within 30 days from the date of despatch for UK orders, 90 days for overseas orders. Claims for shortages and damages must be made within 10 working days from date of receipt. All packaging must be retained for inspection. Claims not received within these periods may not be met. WARRANTY AND OWNERSHIP

a) Subject to the conditions set out below Moore Books warrants that the goods will correspond with the order at the time of delivery and will be free from defects on delivery. If Moore Books is in breach of this warranty the buyer shall notify Moore Books within 14 working days from the date of discovery of the defect. On receiving a notice of failure of warranty Moore Books may, at its sole option either replace all the faulty goods or refund the price of the goods that are defective. This shall be the extent of the liability of Moore Books and no consequential loss claim of any kind shall be made against Moore Books.

b) If you are returning an item because of an error on our part or because it is defective, we will be happy to refund the delivery charges incurred in sending the item to you and your costs in returning it to us. Where you are withdrawing from your purchase within the seven working days cooling-off period, we will also refund the normal postage charge for the delivery of that item but we cannot refund any priority, express or courier component of the postage charge. You will be responsible for those charges and the costs of any other services provided to you in connection with your purchase, for example giftwrapping.

YOUR STATUTORY RIGHTS

a) By law, you also have the right to withdraw from your purchase of an item within seven working days of the day after the date the item is delivered to you. We regret that we cannot accept cancellations of contracts for the purchase of video, DVD, audio, video games and software products where the item has been unsealed.

b) To cancel your purchase under this cooling-off period, please put a note in with your product explaining the reason for the return as "contract cancellation". Please package the relevant item securely and send it to us with the delivery slip so that we receive it within seven working days of the day after the date that the item was delivered to you. Alternatively, please contact us if you would like to return items because of an error on our part or because the item is defective. Please note that this return policy is not applicable for the purchase of online products and electronic products, please contact mailto:enquiries@moorebooks.co.uk for further information.

d) For your protection, we recommend that you use a recorded-delivery service.

e) Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error, or if the item is faulty. As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item's normal postage charge, we cannot refund any priority, express or courier component of the postage charge. WITHDRAWAL OF GOODS

a) Moore Books may withdraw the sale or distribution of any goods produced by or generally supplied by Moore Books without prior notice, or liability, to the Buyer. Please note that Moore Books' website does not have a 'live' link into our main database therefore availability displayed for each title is subject to change.

11) COURT JURISDICTION

a) The Contract and these Terms and Conditions shall be subject to English law and the parties submit to the non-exclusive jurisdiction of the English Courts. These Terms and Conditions are also in line with The Consumer Protection (Distance Selling) Regulations 2000 and the EU Distance Sales Directive of 1998 and the Privacy and Electronic Communications Regulations 2003.

They are provided solely for your convenience and do not constitute any endorsement of any third party products or services. Moore Books accepts no responsibility for any loss or damage you sustain by visiting these websites.

The layout, Site content, Site design, graphics, text, software compilations, underlying source code, software (including applets) and all other material on this Site are copyright Moore Books. ALL RIGHTS RESERVED. Permission is granted to electronically copy and to print in hard copy portions of the Site for the sole purpose of placing an order with Moore Books or using this Site as a shopping resource. Any other use of materials on this Site, including reproduction for purposes other than those noted above, modification, distribution, or republication without prior written permission of Moore Books is strictly prohibited.
